📄 TERMS OF USE (MiyoAI) These Terms of Use and the Privacy Policy are a public offer between MiyoAI and the user. Accepting the terms in the app or buying credits means accepting the offer. 1. The service. MiyoAI is a tool that helps make short videos and images with artificial intelligence (AI). It is made for ordinary users with no special skills. Videos and images are not made by MiyoAI itself but by third-party AI services (the Google Gemini API and/or other international providers) from your request. You pay for each video or image made: the price covers processing your request, making the content with AI, delivering and storing the result. 2. Responsibility. You are FULLY RESPONSIBLE for everything you provide (photos, VIDEOS, text, descriptions, prompts, etc.). MiyoAI is only a technical tool. 2.1. Uploaded photos and videos. By uploading a photo or video you confirm that: (a) you own it or have the right to use it; (b) you have the consent of every person shown in it (including the person you want to replace). You alone are responsible for any unlawful use of someone else's video or likeness, copyright infringement and any related claims. MiyoAI may remove such content and restrict the account without notice. 3. Prohibited content (hereinafter «Prohibited content»): • political campaigning or content that stirs up conflict; • any religious content: sacred figures, prayer and rites, places of worship, holy books, religious symbols, religious preaching, prayers and religious phrases; as well as religious insults or provocation; • sexual content; • violence, terrorism, drugs and illegal acts; • using well-known people or anyone else without consent (deepfakes, misinformation); • material that infringes the rights of others. 4. Moderation. You are responsible for everything you upload and write; even so, MiyoAI additionally checks every request automatically before sending it to an AI service: (1) the text against a list of words related to Prohibited content; (2) an AI language model analyses the meaning of the text and also catches hidden violations; (3) photos, videos and the result are checked by the AI service's own safety filter. These checks do not guarantee that every violation is caught and do not release you from responsibility. We may decline any request and restrict or block the account of a violator. In cases of unlawful activity, data is provided to the competent authorities upon their official request. 5. Data storage. The prompts and requests you enter are kept together with the moderation decisions, including to show in a dispute that a request was entered by you. 6. AI results and no warranty. Your request (prompt) is translated into English, enriched with technical descriptions (camera, lighting, style, etc.) and sent to a third-party AI service. That service makes the result: neither we nor you know in advance how it will turn out, and we cannot influence it. AI results differ every time and may fully or partly not match your request or contain errors (e.g. wrong pronunciation, extra or missing details). The service is provided "as is"; MiyoAI is not responsible for the content, quality or accuracy of the result. 6.1. Credits, complaints and refunds. (a) A credit is the app's internal unit of account for MiyoAI services; 1 credit is sold for 1 000 so'm. Money is exchanged for credits, but credits are not exchanged for money. Credits are bought with a one-time payment through payment systems (Payme, Click and others); there is no subscription. The price (in credits and so'm) and settings are shown before every order; credits are charged after you tap «Make». (b) If a video or image is not made because of a technical error, or the AI service declines the request, the credits are refunded automatically. (c) If you don't like a result, write to 🎧 Support within 7 days of its creation. We will check your request (prompt, photo/video) and the result and reply within 3–5 business days. (d) If there is a technical defect (the result was not delivered, the file is broken or empty, the length or format does not match the order), the credits are returned to your balance. (e) If the result is technically correct but not what you expected (style, face likeness, details), the credits are not refunded — see section 6; we will advise you how to get a better result. Face likeness depends on the photo: upload a clear, front-facing photo of the face. (f) Credits are spent only on MiyoAI services; returned credits go to your balance; credits cannot be exchanged for money (except under (g) and where the law provides otherwise). Think carefully before buying a package and choose the one that suits you. For payment errors (money charged but no credits, or charged twice) after a check the credits are added or the money is refunded through the payment system. (g) A purchase by mistake: if you bought a package by mistake and have not spent a single credit from it, write to 🎧 Support within 3 days of the purchase — the payment will be cancelled and the money returned through the payment system. 7.
